Wer sich nicht wehrt, lebt verkehrt

Grundsicherungsämter haben im vergangenen Jahr massenhaft wegen fehlerhafter Arbeit falsche Hartz-IV-Bescheide erlassen. Das hat die Bundesagentur für Arbeit (BA) laut «Bild»-Zeitung in einem neuen Statistikbericht eingeräumt. Insgesamt wurde in 805.200 Fällen Widerspruch gegen Bescheide eingelegt. 301.500 Widersprüche oder mehr als 37 Prozent seien erfolgreich gewesen. Außerdem hätten 142.700 Hartz-IV-Beziehende gegen ihre Bescheide geklagt. 55.800, also 38 Prozent, haben vor Gericht recht bekommen. Dazu erklärt die stellvertretende Vorsitzende der Partei DIE LINKE, Katja Kipping:

Der Ämterpfusch bei Hartz IV hält weiter an. Wer angesichts der massenhaft rechtswidrigen Arbeit der Ämter Debatten über die Einschränkung und Gebührenerhöhung bei der rechtlichen Wehr gegen Amtsbescheide führt, sägt am Ast der Bürgerrechte. Stattdessen sollte die Wehrhaftigkeit der betroffenen Bürgerinnen und Bürger erhöht werden durch die Finanzierung unabhängiger Beratungsstellen. Der Druck auf die Mitarbeiter zur Senkung der Auszahlleistungen muss aufhören. Dafür sind Qualifizierungen der Mitarbeiter erforderlich. Die hohe Anzahl der erfolgreichen Widersprüche und Klagen bestätigt auch den Satz: Wer sich nicht wehrt, lebt verkehrt.

Massenhaft falsche Hartz IV-Bescheide

Wie die Bundesagentur für Arbeit (BA) in einem internen Bericht bestätigt, wurden haufenweise falsche Hartz IV-Bescheide versandt. Die BA beziffert die falsch erlassenen Arbeitslosengeld II Bescheide mit 162.300. Musterwiderspruch Selbständige Juli 2010

Für alle die es betrifft und anwenden können. Ich lege gegen o.g. Bescheid Widerspruch ein, soweit er rechtswidrig ist, und be­antrage die Zahlung, auch rückwirkend, der rechtswidrig nicht bewilligten Leistun­gen.

Begründung:
1. Der Bescheid ist insgesamt rechtswidrig. Die im System A2LL erstellten Bescheide sind regelmäßig nicht nachvollziehbar und genügen nicht den Anforderungen des § 35 SGB X. Die seitens Ihrer Geschäftsführung angekündigte Nutzung der Freitext-Möglichkeit wird nur unzureichend genutzt. Im Bescheid v. xxx-2010 wird Ihre Abweichung von meiner EKS/Vorausschau nicht abschließend aufgelistet, begründet wird sie überhaupt nicht. Damit bin ich in meinem grundgesetzlich garantierten Recht auf ein rechtsstaatli­ches Verfahren beeinträchtigt. Es ist mir dadurch auch nicht möglich, allen von Ihnen vorgenommenen Kürzungen im Einzelnen durch Tatsachenvorbringung zu widerspre­chen, da sie mir nicht bekannt sind... Lesen Sie weiter:
