But, if you raise questions and comments of a political nature, police officials believe they must enforce a law to restrict your enactment of this right, even though the Constitution insists that Congress shall make no law to abridge the right of people to assemble peaceably for redress of grievance. We believed that expression of grief and remorse for the lost lives of these three men should properly happen in a place where U.S. people mourn the loss of a president’s life. While a U.S. president possesses near-unimaginable power, the men whom we mourned suffered from unimaginable powerlessness. Earnest mourning of these lost lives was crucial for truthful recognition that the U.S. government has used torture as a means of punishment, possibly even lethal punishment, in violation of international law and basic human rights...

The North Atlantic exercise was designed to understand how a spill would behave as the drilling industry plumbed new depths to extract oil and gas. He recently called the $20 billion restitution fund a ’shakedown.’ Although the congressman has rescinded his comments, I also share his strong dislike of this scheme, but not because this is any more of a shakedown than anything else the state does. The American government has a magnificently horrible record of managing any quantity of money both practically and morally, and I don’t see how they would be any better at distributing funds to innocent victims of environmental disasters. The state has also made it standard operating procedure to protect aggressive firms from being brought to complete justice through limited liability laws in an anti-market and fascistic way...

So let me get this straight. We have a court system designed to allow citizens to petition the government for a redress of grievances. However, instead of using the Constitutionally-established judicial system, the president decides that he will tell-not ask, but tell BP that they must put money aside to compensate those who have been harmed as a result of BP’s actions, as well as suspend the payments of dividends to their investors. This fund will also be managed by an unelected, unaccountable third party. And also, don’t forget that for the last 3 weeks the Justice Department has been in the Gulf region looking into what criminal charges they can bring against BP. Here we have the POTUS using his authority, and presumably the threat of his DOJ, to strong arm a private business to do his bidding, without any due process. If this were done to a private citizen, we’d all cry tyranny. But when it happens to a large corporation, the cries are few and far between. There are many reasons why establishing a fund may be a good thing, but there are no legal ones...

Vaccines Scam Disaster - More Than A Pinprick

Babies, they say, are a nice way to start people. They are also, it would appear, a nice way to start profit. If the babies are Indian, there’s added allure to the profit because there are so many of them every year. In the days to come, as the denouement of a series of extraordinary events, the Indian government is expected to make a fresh decision on the number of vaccines Indian infants are to be given soon after birth. Much rests on the decision for Indian families and, oddly, the World Health Organisation (WHO), which has made a bizarre push for new vaccines it wants Indian newborns to be given in the country’s public health programme. A decision one way could risk the lives of the country’s babies because there are doubts on the quality of vaccines the WHO is pitching for. This vaccine soup has been stirred by the WHO, which is in the midst of several controversies of late for creating medical scares and then backing drugs to fight them. In the first week of June, the WHO admitted it had failed to disclose conflict of interest for scientists who advised it on the H1N1 influenza pandemic. The response came after a British media report said the WHO had announced a fake pandemic to boost sales for pharmaceutical companies that manufacture antiviral drugs and the H1N1 vaccine. Merkel muss Kürzungspaket zurück ziehen

Der Vorsitzende der LINKEN, Klaus Ernst fordert von Kanzlerin Merkel eine Rücknahme des Kürzungspakets der Bundesregierung. Andernfalls sei dies ein Beweis dafür, dass die Kanzlerin nicht mehr die Richtlinienkompetenz in ihrer Regierung habe. Ernst erklärt:

Merkel muss das Kürzungspaket zurückziehen. Es ist sozial ungerecht und ein Betrug an den Wählern. Im Wahlkampf hat Schwarz-Gelb weder Sozialabbau noch Steuererhöhungen angekündigt. Merkel hat sogar noch am 9. November 2009 in einer Regierungserklärung gesagt, dass Streichen und Kürzungen in der Krise "offensichtlich keine Lösung" seien. Inzwischen hat sich die Krise an den Finanzmärkten sogar noch verschärft. Aber heute plant Merkel genau jene "größte Kürzungs- und Streichungsaktion in der Geschichte der Bundesrepublik", vor der sie im November 2009 noch gewarnt hat. Entweder macht Merkel heute Politik gegen ihre eigenen Überzeugungen, oder sie hat damals bewusst versucht, die Menschen zu täuschen. Sie hat keine Strategie für die Überwindung der Krise. Merkel lässt sich von den Sozialstaatsfeinden aus der FDP auf der Nase herumtanzen, die in Wirklichkeit die Politik bestimmen. Wenn Merkel nicht die Kraft hat, dieses Kürzungspaket zurück zu ziehen, dann ist das nur ein weiterer Beweis dafür, dass sie längst nicht mehr die Richtlinienkompetenz in ihrer Regierung hat.

Staatsfinanzen nicht durch Sozialabbau sanieren

Die Vorsitzende der LINKEN, Gesine Lötzsch verlangt unmittelbar vor der Vorlage des Entwurfs für den Bundeshaushalt 2011 "mehr Transparenz im Bundeshaushalt" und schlägt einen "Stufenplan zur Verbesserung der Staatsfinanzen" mit Maßnahmen zur Erhöhung der Einnahmen der öffentlichen Haushalte vor. Lötzsch erklärt:

Zur Klarheit über den Haushalt gehört, dass die Menschen im Land erfahren, was sich real hinter den Zahlen des Etatentwurfs verbirgt. Die Bundesregierung muss mit dem Etatentwurf alle damit zusammenhängenden konkreten Gesetzesvorhaben offenlegen. Wenn ein Posten im Etatentwurf gekürzt wird, dann müssen wir auch wissen, wer konkret dafür bluten soll. DIE LINKE lehnt Sozialabbau zur Sanierung der Staatsfinanzen ab. Die Bundesregierung sollte stattdessen einen Stufenplan zur Verbesserung der Staatsfinanzen vorlegen. Einen Bundeshaushalt kann man nicht gesundsparen. Zur Verbesserung der Einnahmen schlagen wir drei konkrete Punkte vor. Auf Vermögen über eine Million Euro sollte eine Sondersteuer von fünf Prozent erhoben werden. Zusätzlich zu dieser Millionärssteuer müssen Börsengeschäfte künftig mit einer Umsatzsteuer belegt werden. Der Spitzensteuersatz sollte auf 53 Prozent steigen.

(14.06.2010) Die Bundesagentur für Arbeit befürchtet eine neue Hartz IV- Klagewelle aufgrund der von einzelnen Krankenkassen geforderten Zusatzbeiträgen. Laut dem Magazin "Focus" habe der Chef der Bundesagentur für Arbeit (BA), Heinrich Alt, einen entsprechenden Hinweis an den Bundestagsausschuss für Arbeit und Soziales gesandt. Alt sehe keinen Anspruch für ALG II-Bezieher, das dieser Zusatzbeitrag von den Behörden übernommen werden ssoll. Dennoch sehe er, dass zahlreiche Kläger sich auf die sog. "Härtefallregelung" berufen könnten. "Hier sehe ich Widersprüche und Klageverfahren auf uns zukommen“, so Alt gegenüber dem Focus. Derzeit würden die Behörden versuchen zu ermitteln, wieviele Menschen von den Zusatzbeiträgen der Krankenkassen betroffen sind. Bundesagentur für Arbeit will Briefe durch Postmitarbeiter einscannen lassen. Das ab September in zwei Bundesländern eingeführte Verfahren dient der Umstellung auf "E-Akten"

„Die Bundesagentur für Arbeit will Briefe aus Sachsen-Anhalt und Thüringen ab September von Postmitarbeitern öffnen und einscannen lassen. Anschließend sollen die Inhalte an die Sachbearbeiter weitergeleitet und Bestandteil einer elektronischen Akte werden. Betroffen sind neben Arbeitslosen auch Kindergeldempfänger, deren Ansprüche ebenfalls über die Bundesagentur geregelt werden. (…) Das Pilotprojekt in den beiden Bundesländern ist datenschutzrechtlich unter anderem deshalb problematisch, weil das Scannen der Dokumente nicht von Beamten, sondern von Geringverdienern erledigt werden sollen. Aus diesem Grund besteht trotz einer formellen Schweigepflicht der Postmitarbeiter und einer Zertifizierung des Verfahrens durch das Bundesamt für Sicherheit in der Informationstechnik nicht nur ein erhebliches Risiko, dass persönliche Daten an die Öffentlichkeit oder in falsche Hände gelangen, sondern auch, dass für die Einhaltung von Fristen wichtige Post verschlampt, falsch zugeordnet oder aus Überlastung weggeworfen wird. Allerdings gibt es dieses Risiko seit der Teilprivatisierung der ehemaligen Behörde auch im traditionellen Beförderungsweg: Nach Recherchen des Korruptionsforschers Werner Rügemer verschwinden täglich 30.000 Briefe. Few people are willing so publicly to confess to tribal biases and detail how they struggle to overcome them, even though that’s a challenge which any person who evolves at some point must confront. That process — far more than the pretense of having always been bias-free — requires difficult self-examination, and its public discussion offers vitally needed lessons for everyone. Many people are unwilling ever to engage that process privately, let alone candidly describe it publicly. Those with the courage to do so, like Sherrod, should be heralded for that candor. Instead, she was slandered, falsely disparaged, and fired...

Where is due process in all of what he and Congress have been doing lately? Or has an anti-British or anti-business attitude wiped out the need for justice? Urging or imploring — even attempting to persuade — BP to set up the $20 billion fund could be a good idea but treating this as demanded by justice is utterly misguided. Gulf Oil Spill ‘Could Go Years’ If Not Dealt With

The Obama Administration and senior BP officials are frantically working not to stop the world’s worst oil disaster, but to hide the true extent of the actual ecological catastrophe. Senior researchers tell us that the BP drilling hit one of the oil migration channels and that the leakage could continue for years unless decisive steps are undertaken, something that seems far from the present strategy. There is a deafening silence from the very environmental organizations which ought to be at the barricades demanding that BP, the US Government and others act decisively. Environmental non-profit groups that have accepted donations from or joined in projects with BP include Nature Conservancy, Conservation International, Environmental Defense Fund, Sierra Club and Audubon. That could explain why the political outcry to date for decisive action in the Gulf has been so muted. Of course those organizations are not going to be the ones to solve this catastrophe. The central point at this point is who is prepared to put the urgently demanded federal and international scientific resources into solving this crisis. Further actions of the likes of that from the Obama White House to date or from BP can only lead to the conclusion that some very powerful people want this debacle to continue. The next weeks will be critical to that assessment.

Our national frustration continues to rise with each new drop of BP oil that leaks into the Gulf of Mexico. Everyone knows we can’t legislate away environmental risks without consigning ourselves to the Stone Age. What’s needed going forward is a comprehensive legal strategy that addresses the risks though a combination of regulation before the fact and tort liability (and criminal sanctions where appropriate) afterwards. Tort remedies are essential to protect people (and their property) who do not have contractual relations with defendants from harms such as air and water pollution. The legal system should never allow self-interested parties to keep for themselves all the gains from dangerous activities that unilaterally impose losses on others — which is why the most devout defender of laissez-faire must insist, not just concede, that tough medicine is needed in these cases. The fundamental question here is one of technique: What mix of before and after sanctions will do the job at the lowest cost?

The oil giant makes only a small portion of its profits from retail gas sales, and can sell excess fuel to other retailers.The 10,000 BP gas stations in the United States are run by small business owners with supply contracts to various oil companies, not just BP, which are difficult and costly to break. ‘Anytime you boycott a local gas station you’re doing far more harm to that station owner than who they’re buying their gas from,’ said Brandon Wright, a spokesman from the Petroleum Marketers Association of America. Klammheimlich soll über einen Änderungsantrag, über den der "Ausschuss für Gesundheit" beim Deutschen Bundestag erst am Mittwoch, 16. Juni 2010, beraten hat, eine neue Regelung zur Einführung der elektronischen Gesundheitskarte beschlossen werden. Bisher ist in dem Gesetz nicht vorgesehen, dass die "Stammdaten" der Patienten beim Arztbesuch online mit den bei den Krankenkassen gespeicherten Daten abgeglichen werden. Über diese bisher nicht geregelte Funktion soll nun aber die Einführung der eGK, gegen die es vielfältige Proteste und gute Argumente gibt, protegiert werden. The Truth About Chernobyl

Reading the long, detailed and carefully referenced account of the harm caused by the Chernobyl explosion is a very sobering experience. It is in stark contrast to the summary of the report of the Chernobyl Forum. The complacent IAEA reports are in stark contrast to what is being observed by people on the ground. Doctors and other medical health workers in the former Soviet Union and other countries are reporting far more deaths and radiation-related illnesses than the official figures show. Yablokov and his colleagues have made vast quantities of evidence available to those us who cannot read Slavic languages; there is now even less excuse for ignoring it. For the IAEA to persist in claiming that no more than a few thousand people were killed or injured as a result of Chernobyl and that those who fear the after effects are mostly suffering from psychological problems is an insult to all those who live in the shadow of the explosion. It is grossly i rresponsible for governments and the nuclear industry to cite those figures as justification for building new nuclear plants all over the world. Were a major incident to occur – and sooner or later one is bound to – the consequences could be catastrophic. We simply cannot afford to go nuclear.

The Turks are of the opinion that a more cooperative approach from Iran’s neighbors might make Tehran stop short of making a bomb. In other words, Iran might feel secure enough to halt at developing technology that would enable it to construct a weapon on short notice — much as Japan has already done...

If we’re apportioning blame for what has encouraged Turkey on its more independent course, we can assign quite a bit to both the Bush and Obama administrations, but that is not the only thing that interests me here. The men on Elmer’s Island don’t wear respirators since BP and OSHA have thrown precaution to the wind and deemed them unnecessary. But the only type of air-monitoring equipment Elmer’s ever seen on the island are little multigas meters that are not up to the job: They’re designed for indoor use, clog easily, and only measure limited types of pollutants. And despite the known dangers of dispersants and the toxic chemicals in crude (I can attest that contact with the stuff washing up on the beach can burn), workers aren’t even wearing protective Tyvek suits anymore. Of course, there are medics on hand to treat anyone who gets hurt or sick. Unfortunately, any worker who asks for a medic’s help is automatically drug tested, which, for some, can be a powerful incentive to not report injuries. (Not that keeping a cleanup job necessarily equals getting paid: Elmer says the contractors continue to lose workers’ paychecks, a problem he told me about the last time we talked and that has since been confirmed by the local papers.)...

Nachdem Anti-Atom-Bewegte aus über 50 Städten Anfang des Monats bereits ihr CDU-Büro mit Müll besucht haben, wollen wir die Diskussion über das ungelöste Müllproblem verstärken, denn die Regierenden tun bei der aktuellen Diskussion um Laufzeiten so, als spielte das keine Rolle. Daher haben wir eine neue Kampagne gestartet und machen unmissverständlich klar: "Schwarz-Gelb macht nur Müll!" Hilf mit und spende ein Großflächenplakat gegen die Atommüll-Mafia, damit das Thema im August, also kurz vor der Entscheidung des Bundeskabinetts über die Zukunft der Atomenergie nicht unter den Teppich gekehrt wird. Buche ein Plakat bis zum 8. August, ob im Berliner Regierungsviertel, in einem Feriengebiet oder an einem markanten Platz in Deiner Stadt.

Neben den Großplakaten soll das Thema auch vor Ort eine Rolle spielen: Ab nächster Woche könnt Ihr Flyer und Plakate mit dem Motiv "Schwarz-Gelb macht nur Müll" bestellen. Zu diesem Zeitpunkt starten noch mehr dezentrale Aktionen, zum Beispiel unsere Atommüll-Aktion, bei der "strahlender" Müll an Jedermann und -frau verteilt werden kann. Bundesweite Großdemo am 18. September in Berlin Ein Pflichttermin für alle AtomkraftgegnerInnen: Für Samstag, den 18. September, planen wir mit vielen Bündnispartnern die nächsten Massenproteste gegen Atomkraft. Denn wenn Bundestag und Bundesregierung über ein sogenanntes "Energiekonzept" diskutieren, wollen auch wir ein Wörtchen mitreden. Unsere Nachricht: Die Zukunft der Atomenergie heißt Abschalten. In Berlin werden deshalb Zehntausende mit einer bundesweiten Großdemo das ganze Regierungsviertel umzingeln, um deutlich zu machen, dass die Bevölkerung endlich raus will aus der Atomkraft.

Protest gegen den Castor-Transport nach Gorleben Bereits im Sommer beginnen wir, für den Castor-Protest im Herbst zu mobilisieren. Denn dann soll wieder Atommüll in Richtung Gorleben rollen, obwohl es dort kein sicheres Lager für die strahlenden Abfälle gibt. Geplant ist eine Groß-Demo in Dannenberg im November und vielfältige Aktionen entlang der gesamten Transportstrecke.

The Supreme Court today denied a petition of review from Maher Arar, the Canadian and Syrian citizen who was abducted by the U.S. Government at a stopover at JFK Airport when returning to Canada in 2002, held incommunicado for two weeks, and then rendered to Syria, where he spent the next 10 months being tortured, even though — as everyone acknowledges — he was guilty of absolutely nothing. Arar sued the U.S. Government for what was done to him, and last November, the Second Circuit Court of Appeals upheld the dismissal of his lawsuit on the ground that courts have no right to interfere in these decisions of the Executive Branch. That was the decision which the U.S. Supreme Court let stand today, ending Arar’s attempt to be compensated for what was done to him.

This week the Supreme Court denied, without comment, the appeal of Maher Arar, a dual citizen of Canada and Syria who was arrested in transit through JFK airport in 2002, then shipped off to Syria and tortured for 10 months. Arar’s abuse allegedly included repeated beatings with electrical cables and confinement in a cell the size of a grave. When they realized they had the wrong guy — the really, totally, and utterly innocent guy — Arar was released without charges. He was then completely exonerated of any link to terror by the Canadian government, which impaneled a commission to investigate the incident, issued a 1,000-plus-page report on the matter, held its own intelligence forces responsible for their role in the screw-up, then apologized and paid Arar $9.8 million. Whereas the U.S. government — as Glenn Greenwald observes — has never apologized, never acknowledged any wrongdoing, never held anyone responsible, and, on President Barack Obama’s watch, has only redoubled its efforts to prevent Arar from having even a single day in court...

„Die ARGE Wuppertal finanziert seit einiger Zeit Wachleute, die eine Baustelle sowie einen neu gebauten Fußweg auf einer stillgelegten Bahnstrecke bewachen. Es handelt sich um ein kurzes Teilstück der sogenannten Nordbahntrasse, um die es aus verschiedenen Richtungen schon seit Monaten negative Schlagzeilen gibt. Etwa 20 Personen führen dort Wach.- und Sicherungstätigkeiten aus. Die Wachleute werden von der Wichernhaus Wuppertal gGmbH gestellt. „Die Schlägerei in einem Büro der Arbeitsförderung Schwalm-Eder (Arge) sei nur die Spitze eines länger schwelenden Konflikts gewesen, sagt Lutz Baumann, Vorsitzender des Vereins Organisierter Arbeitsloser Schwalm-Eder (Oase). Der arbeitslose Diplom-Ingenieur und Chemiker kritisiert die Praktiken der Behörde massiv: Immer wieder komme es vor, dass Mitarbeiter der Arge ungerechtfertigt Leistungen kürzten oder Geld nicht auszahlen, dass den Menschen zustehe. In den Räumen der Arge war es vor einigen Wochen wegen eines Schecks zu einer tätlichen Auseinandersetzung gekommen. Kein Sommermärchen auf dem Arbeitsmarkt

Zur Situation auf dem deutschen Arbeitsmarkt im Monat Juni erklärt die Bundesgeschäftsführerin der Partei DIE LINKE, Caren Lay:

3,153 Millionen Menschen waren im Monat Juni ohne Arbeit – offiziell. Jenseits geschönter Zahlen liegt die Arbeitslosigkeit bedeutend höher. DIE LINKE hat auch in diesem Monat nachgerechnet: 4,332 Millionen sind es wirklich, wenn man diejenigen mit einrechnet, die in Minijobs oder arbeitsmarktpolitischen Maßnahmen geparkt sind. So positiv der Rückgang der Arbeitslosigkeit für jede und jeden Einzelnen ist, von einem Sommermärchen auf dem Arbeitsmarkt kann man nicht sprechen. Eine übergroße Zahl der neuen Arbeitsplätze sind Mini- und Midijobs, fallen unter die Kurzarbeiterregelung oder sind prekäre Beschäftigungsverhältnisse. Von einem wirklichen Aufschwung am Arbeitsmarkt, vom Entstehen notwendiger sozialversicherungspflichtiger, existenzsichernder Arbeit ist Deutschland weit entfernt – und wird es bleiben, wenn die angekündigten Sparmaßnahmen aus dem Hause von der Leyen und Schäuble greifen. Das Statistische Bundesamt hat Zahlen veröffentlicht, wonach sich im vergangenen Jahr 8,6 Millionen Menschen Arbeit oder mehr Arbeitsstunden wünschten. Hier versagt die Arbeitsmarktpolitik der Bundesregierung. Ein Gegensteuern ist dringend geboten. Aus Sicht der LINKEN braucht es einen flächendeckenden gesetzlichen Mindestlohn, der Nachfrage und somit Arbeit schafft. Es braucht ein Investitionsprogramm und vor allem arbeitsmarktpolitische Programme, die diesen Namen auch verdienen und Menschen in Arbeit bringen statt sie zu verwalten. Die Einführung eines öffentlich geförderten Beschäftigungssektors wäre dazu ein erster Schritt.
